##HowMali’sCybercrimeFrameworkBecameaPressFreedomIssue

ThecontroversyisrootedpartlyintheevolutionofMali’scybercrimelegislation.

Cybercrimelegislationisordinarilyintendedtoaddressoffencessuchasunlawfulaccesstocomputersystems,onlinefraud,digitalattacksandotherformsoftechnology-enabledcrime.

Pressfreedomorganisations,however,arguethatbroadlywordedprovisionsrelatingtoonlinespeech,statecredibility,insults,falseinformationandnationalsecuritycancreateopportunitiesforauthoritiestocriminaliselegitimatejournalism.

##BalancingSecurityandPressFreedom

Malianauthoritiesfacelegitimatesecuritychallengesand,likegovernmentselsewhere,havearesponsibilitytoinvestigatecybercrime,disinformationcampaigns,threatsandotherunlawfuldigitalactivities.

However,pressfreedomorganisationsmaintainthatsuchresponsibilitiesmustbeexercisedwithinclearlegalboundariesandwithsafeguardsforlegitimatejournalism.

ThecentralissueisthereforenotwhetherMalishouldregulateharmfulonlineactivity,butwhethercybercrimelegislationisbeingappliedproportionatelyandconsistentlywithprotectionsforfreedomofexpression.

Forjournalists,thedistinctioniscritical.

Afunctioningmediasystemrequiresreporterstobeabletoquestiongovernmentpolicy,investigateallegations,discusssecurityfailuresandcriticisepublicinstitutionswithoutautomaticallyfacingcriminalprosecution.

ThecasesofTakiou,Keïta,SissokoandBathilyhaveplacedthatprincipleatthecentreofthedebateoverMali’scybercrimelaws.
